1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the site or place an order.

2. Who we are

Exelum is an approved retailer of InstaMed products. We sell products manufactured by InstaMed in the manufacturer's original sealed packaging. Product formulas, serving sizes and counts are stated as provided by the manufacturer.

3. Product information

We work to describe products and prices accurately. Colors, packaging and label designs may vary from images shown. If a product is described incorrectly, your remedy is to return it under our Returns & Refunds Policy.

Products sold on this site are dietary supplements. Statements about them have not been evaluated by the Food and Drug Administration. The products are not intended to diagnose, treat, cure, or prevent any disease. Information on this site is for general informational purposes only and is not medical advice. Consult your healthcare provider before using any dietary supplement.

4. Orders and acceptance

Your order is an offer to buy. We may accept or decline any order, limit quantities, or cancel an order after acceptance, for example if a product is unavailable, a price or description was listed in error, or we suspect fraud. If we cancel an order you have paid for, we will refund the full amount to your original payment method.

5. Prices and payment

Prices are shown in US dollars and do not include applicable taxes or shipping unless stated. We may change prices at any time; the price that applies is the one shown when you place your order. Payment is processed by our third-party payment processor. By submitting payment, you confirm that you are authorized to use the payment method.

6. Shipping, returns and refunds

Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Returns & Refunds Policy. Both are part of these Terms.

7. Acceptable use

You agree not to use the site for any unlawful purpose; not to resell products purchased from us unless authorized in writing; not to interfere with the site's security or operation; and not to use automated tools to collect data from the site without our permission.

8. Intellectual property

The site content, including text, graphics and design, belongs to Exelum or its licensors and is protected by law. InstaMed names and marks belong to their respective owner. You may not copy or reuse site content without our written permission.

9. Disclaimer of warranties

Except as expressly stated in these Terms and to the fullest extent permitted by law, the site and products are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Any manufacturer warranty is provided by the manufacturer.

10. Limitation of liability

To the fullest extent permitted by law, Exelum will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

11. Indemnification

You agree to indemnify and hold Exelum harmless from claims, losses and expenses, including reasonable attorneys' fees, arising from your breach of these Terms or misuse of the site or products.

12. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us at support@exelum.one and try to resolve the dispute informally for at least 30 days.

13. Changes to these Terms

We may update these Terms from time to time. The version posted on the site at the time of your order applies to that order.

14. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies referenced in them, are the entire agreement between you and Exelum regarding the site.
